A federal judge ruled Monday that President Bush had both overstepped his constitutional bounds and improperly brushed aside the Geneva Conventions in establishing military commissions to try detainees at the United States naval base here as war criminals.<\/p><\/blockquote>\n

“There is nothing in this record to suggest that a competent tribunal has determined that Hamdan is not a prisoner of war under the Geneva Conventions … the President has already determined that detained al Qaeda members are not prisoners-of-war under the Geneva Conventions. The President is not a ‘tribunal,’ however. The government must convene a competent tribunal … The government has asserted a position starkly different from the positions and behavior of the United States in previous conflicts, one that can only weaken the United States’ own ability to demand application of the Geneva Conventions to Americans captured during armed conflicts abroad.”<\/p><\/blockquote>\n
